Introduction

This wikicharities.org site ("WikiCharities", “our site”, “this site”, "we", "our", or "us") is owned and operated by Given Tree, doing business as (DBA) WikiCharities. Please read these terms and conditions carefully before using our site. By using this site, you automatically agree to all of these terms of use. WikiCharities may revise these terms from time to time and you should review the Website and Agreement from time to time for any modifications. If you continue to use our site after we post changes to these terms and conditions, it will mean that you accept those changes.  This Terms of Use are a binding agreement between you and WikiCharities.  

WikiCharities is under no obligation to accept any user ("nonprofit", "charity", or "log in user") as a nonprofit on our website.  WikiCharities may accept or reject any registration in its sole and complete discretion. In addition, WikiCharities may deactivate any profile ("account")  at any time, including, without limitation, if it determines that a user has violated the Agreement.

Modifications

This Agreement supersedes any previous Agreement to which you and WikiCharities may have been bound. This agreement may be modified by WikiCharities in its sole discretion from time to time and such modifications shall automatically become part of this Agreement and shall be effective once posted by WikiCharities on the Website. Your participation in the Program and use of the Website will be subject to any such modifications. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.

Description of Use of Services

WikiCharities helps viewers ("customers", "partners", "donors", and other interested parties) search for nonprofits, and/or their services by location, name and topic.  WikiCharities allows nonprofits ("charities") to be listed on our website. WikiCharities provides a validation for nonprofits.  Nonprofits who are not validated can still be listed on our website.  WikiCharities reserves the right to remove any listing at the sole discretion of WikiCharities.  Nonprofits who are not validated by WikiCharities or other entities can still be listed on our Website.  WikiCharities helps viewers find nonprofits and/or services, helps nonprofits have a presence on WikiCharities and be searchable, helps donors support projects and nonprofits based on the information that WikiCharities has collected, compiled, assembled, acquired on charities and/or nonprofit organizations globally.

Permitted & Prohibited Uses

Permitted Uses. You may access and use the Website for the following purposes:

  • To search for nonprofit organizations ("charitable organizations") and services for the purpose of obtaining contact information and any public information listed on a nonprofit's account.
  • To learn about nonprofit organizations and their services for the purpose of evaluating them and the content they provide for donation purposes, volunteer purposes, partnership purposes, and collaborative purposes. 
  • To learn more about nonprofit organizations or general topics of interest for the purpose of improving the nonprofit community.
  • To review nonprofits for the purpose of supporting their mission through donations, in-kind donations, goods and/or services.
  • To research the nonprofit sector and compare information and/or best practices. 
  • To financially contribute to nonprofit organizations who are validated on WikiCharities.

Prohibited Uses. You may not:

  • Use the website, and the content found on the website, other than what is stated in the Terms of Use.
  • Use the content of the website, or the website, for the benefit of any third party, without written permission from WikiCharities.
  • Distribute or use content from the website to republish without the approval of WikiCharities.
  • Change or modify information from the website without the written approval of WikiCharities.
  • Do anything to interfere or impede the operation of the website or alter contents of the website.
  • Directly or indirectly sell, rent, publish, distribute, change, recompile or reframe any of the website, any data or database thereon and/or content thereon, or any part of the website, without explicit written consent and approval from WikiCharities.
  • Use any robots, data mining, or gathering data and extraction methods on the website or with respects to the website or any part or portion of the website; or;
  • Use the website in competition with WikiCharities either directly or indirectly in any way whatsoever.

All logos, seals, and images associated with WikiCharities is the property of Given Tree and are subject to the copyright and trademark laws of the United States.

Account; Password; Unique Identifiers

During the claiming process and/or application process, we will ask you to create an account, which includes the organization's name, contact name and email address along with any other information that will assist in authenticating your identity when you log-in in the future. When creating your account, you must be affiliated with the nonprofit you are claiming and registering, you must provide true, accurate, current, and complete information. You are solely responsible for the confidentiality and use of your account information.  You are also responsible for any use, misuse, or communications entered through the services provided on our website. We reserve the right to cancel, change, or delete any information or accounts at any time and for any reason.  WikiCharities will not be liable to any loss or damage caused by any unauthorized use of your account.   WikiCharities reserves the right to impose password/security precautions on an account.

User Content & Licenses

WikiCharities maintains this site for communication, information, and education. Feel free to browse our site. All materials on our site are the sole property of WikiCharities or its licensors and partners. The exclusive rights to all materials on this site are protected by U.S. and international laws of copyright, trademark and unfair competition.

3rd Party Websites & Resources

WikiCharities has not reviewed all of the sites linked to this site and is not responsible for the privacy practices or content of any off-site pages or any other sites linked to this site, whether or not they are affiliated with WikiCharities. Nonprofits who are not validated by WikiCharities or other entities can still be listed on our Website.  WikiCharities makes no representations or warranties as to the accuracy or functioning of any such link. That another web site is linked to our site does not constitute endorsement by WikiCharities of the owner of the other site, the content of its site, or its products or services.

Termination

We reserve the right, in our sole discretion, to suspend, change, delete, terminate, or restrict access to all and any parts of our website, user accounts, and content at any time, and for any reason without prior notice or liability.

WikiCharities manages the website, which makes public the information provided us by participating nonprofits as they enter information into their profile and complete the validation application.  WikiCharities has the sole discretion to decide what information is made public and what information is kept internally. All parties agree that by entering information on our website, they take full responsibility to the validity of the information provided.

Disputes & Jurisdiction

These terms shall be governed by and construed according to the laws of the state of California, as they are applied to agreements entered into and to be performed entirely within California. Any claim or cause of action arising out of or relating to these terms shall be barred unless such claim or cause of action is brought within one year after it arises; any such claim or cause of action shall be brought only in the state or federal courts in the state of California, and you consent to jurisdiction of such courts for the purpose of litigating such actions.

Disclaimers

You agree that by using the wikicharities.org site, you allow the collection, retrieval, transfer, and storage of information you input on your profile. You acknowledge that any and all information you input into your profile and/or validation application can be used at the sole discretion of WikiCharities.  WikiCharities has the right to use this information however we deem useful for our mission.  Please see ‘Privacy Policy’ for more detailed information. WikiCharities does not store your credit card information. We use third-party payment systems for all our fund transfers. Any problems or concerns with this system is not the responsibility of WikiCharities.

All endorsements, uploaded documents, and any and all content on our website added by users, account holders, nonprofits, and/or validated nonprofits is not the responsibility of WikiCharities based on accuracy and warranty.  The accuracy of the information provided is not the responsibility of WikiCharities.

Liability Limitations

Under no circumstances, including, but not limited to, negligence, shall WikiCharities be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information) arising out of or in connection with the use of, or inability to use or have access to this site. We disclaim all liability for any loss, damage (in any form, direct or otherwise), personal injury, expense, or liability of any nature whatsoever incurred by you, your company, or a third party as a result of the use of our website, any information contained on the website, or information transmitted over our site.  WikiCharities and its members are not liable for damages or losses. 

WikiCharities makes no warranties about the contents of the services provided on this website, including, without limitation, content (including, without limitation, any endorsements, reviews, financial data, outside links, uploaded documents, uploaded images) or user content.  We shall not be subject to liability for any errors, delays or interruptions of the services from whatever cause.  You agree to use this website at your own risk. 

We do not warrant that the website, and the content and services, will operate without error or free of computer viruses or features that might result in the destruction of equipment or data. We are not responsible for the costs results in above mentioned areas.  All content and services on WikiCharities are provided without any warranties on an "as is" and "as available" basis.

Donations

All funds given to WikiCharities are considered donations. You will receive a receipt via email. If you do not receive a receipt, you can request one through email. This can be used for tax purposes. All funds are tax exempt based on the 501(c)(3) nonprofit status of the partnering organization. WikiCharities is the holder of funds for nonprofit partners until funds are dispersed.

Donors

WikiCharities manages the website, which also matches you and other persons (each, a “Donor”, and, collectively, “Donors”) with projects submitted and proposed by third-party partners. These partners take on the responsibility of using the funds submitted designated as outlined in their proposals. There is always risk involved when giving funds to any organization. We try to eliminate risk by requiring these organizations (“validated nonprofits”) to report back through annual impact reports on how the funds were used. However, not withstanding our efforts to require accountability, we are not responsible for how funds are ultimately used once released to third-party partners or validated nonprofits. We also reserve all rights to do with undesignated or excess funds how we deem fit based on our judgment. WikiCharities is not responsible for funds once they are released to the designated partner chosen by you (the “Donor”).

Other Terms

This is the entire agreement between us relating to your use of this site. These terms may not be modified by you, in writing or otherwise, unless agreed to in a written document signed by WikiCharities. You represent and warrant to WikiCharities that you are at least eighteen (18) years old and that you possess the legal right and ability to enter into this agreement and to use the site in accordance with this agreement.
